1. Agreement to Terms

By accessing www.brandedpickleball.com or placing an order with Branded Pickleball (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.

2. Our Services

Branded Pickleball specializes in custom printed pickleball paddles, custom padel rackets, branded pickleball sets, and related accessories for businesses, distributors, and organizations. All products are printed in-house at our facility in St. Petersburg, Florida. We source our paddles and rackets from trusted manufacturers, stock them at our warehouse, and handle all custom printing and order fulfillment on-site. We work primarily with B2B clients, including distributors, corporate buyers, event planners, pickleball clubs, resorts, and promotional product companies.

3. Orders & Quotes

All orders begin with a quote request or online order through our website. Quotes are valid for 30 days from the date issued unless otherwise stated in writing. An order is considered confirmed once the customer approves the proof via email and payment is received (or net 30 terms have been arranged in advance). Minimum order quantities apply to all custom printed products: 10 paddles for individual paddle orders and 5 sets for pickleball set orders. We reserve the right to decline any order at our sole discretion. Rush orders may be accommodated depending on current production volume and are subject to additional fees.

4. Artwork & Customer-Supplied Files

You are responsible for providing print-ready artwork in the required format. We prefer vector files such as .AI, .EPS, or SVG, as well as high-resolution .PDF or .PNG files (minimum 300 DPI). By submitting artwork, logos, or design files, you represent and warrant that you own or have the legal right to reproduce all submitted content. We will provide a digital proof for your review and approval before production begins. Production will not start until the customer replies to the proof email confirming approval. Once a proof is approved, Branded Pickleball is not responsible for errors in spelling, color accuracy, layout, or design that were present in the approved proof. We reserve the right to refuse artwork that contains illegal, offensive, or infringing content.

5. Pricing & Payment

All prices are quoted in U.S. dollars. For custom orders placed through a quote or invoice, full payment is required before production begins unless net 30 terms have been arranged in advance. For orders placed directly through our website, full payment is collected at checkout. Prices do not include applicable sales tax or shipping charges unless explicitly stated in your quote or at checkout. We reserve the right to adjust pricing at any time; however, confirmed and paid orders will be honored at the original quoted or purchased price.

6. Production & Turnaround

Standard production time for custom printed pickleball paddles and accessories is 3–5 business days from the date the customer approves the proof via email and payment is received (or net 30 terms are in place). Production timelines may vary depending on order volume, complexity, or seasonal demand. Production timelines are estimates only and are not guaranteed delivery dates. Branded Pickleball is not liable for production delays caused by supply chain disruptions, material shortages, equipment issues, or other circumstances beyond our reasonable control. Rush production may be available for an additional fee. Contact us for rush availability.

7. Shipping, Delivery & Risk of Loss

All orders are shipped via UPS or FedEx, selected at the time of fulfillment. Shipping costs are calculated at checkout or included in your custom quote. We provide tracking information for every shipment.

Title and risk of loss for all products transfer to the customer at the time the shipment is tendered to the carrier (i.e., when the package is picked up or dropped off with UPS, FedEx, or any other shipping carrier). Once your order has been shipped and a tracking number has been provided, Branded Pickleball is not responsible for packages that are delayed, damaged, lost, or stolen during transit.

Branded Pickleball cannot guarantee specific in-hand delivery dates. While we make every effort to meet requested timelines by producing and shipping orders promptly, actual delivery dates are controlled entirely by the shipping carrier. We are not responsible if UPS, FedEx, or any other carrier delivers late, experiences service disruptions, weather delays, or any other issue that affects transit times. If your order has a firm in-hand deadline, we strongly recommend selecting an expedited shipping method and building in a buffer of at least 2–3 business days.

If a carrier marks a package as delivered but you did not receive it, or if a package is lost in transit, the customer is responsible for filing a claim directly with the shipping carrier. Branded Pickleball will provide all necessary shipment documentation (tracking numbers, proof of shipment, weight, dimensions) to assist with your carrier claim, but we are not financially responsible for lost, stolen, or misdelivered packages once the shipment has been tendered to the carrier.

If your order arrives with visible damage to the packaging or products, please document the damage with photos immediately upon delivery and contact us within 48 hours through our website at www.brandedpickleball.com/contact. We will work with you to resolve the issue, which may include filing a carrier damage claim or reprinting affected items at our discretion.

8. Returns, Refunds & Cancellations

Because all products are custom printed to your specifications, all sales are final. We do not accept returns or issue refunds on custom-printed pickleball paddles, padel rackets, sets, or accessories unless there is a verified manufacturing or printing defect. If you believe your order has a defect, please contact us within 7 business days of delivery with photos of the issue. We will review the claim and, if a defect is confirmed, offer a reprint or credit at our discretion. Orders cannot be cancelled once production has begun. If you need to cancel before production starts, contact us immediately. Payments on cancelled orders are non-refundable once production has begun.

9. Intellectual Property

All content on www.brandedpickleball.com, including text, graphics, logos, images, and software, is the property of Branded Pickleball and is protected by applicable intellectual property laws. Customer-supplied artwork, logos, and design files remain the property of the customer. By submitting artwork, you grant Branded Pickleball a non-exclusive, royalty-free license to use it for the purpose of fulfilling your order and for displaying completed work on our website, social media, portfolio, and marketing materials.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Branded Pickleball shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or products, including but not limited to lost profits, business interruption, or loss of data. Our total aggregate liability for any claim related to a specific order shall not exceed the total amount paid by the customer for that specific order.

11. Indemnification

You agree to indemnify, defend, and hold harmless Branded Pickleball, its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of our website or services; (b) your breach of these Terms; (c) your submitted artwork, designs, or content infringing upon the intellectual property rights of any third party; or (d) your resale or distribution of custom products.

12. Distributor & Reseller Terms

Branded Pickleball works with distributors, resellers, and promotional product companies. If you are ordering on behalf of an end client, you are responsible for ensuring that all artwork approvals, delivery timelines, and product specifications are communicated accurately. Branded Pickleball is not liable for miscommunications between you and your end client. Wholesale and volume pricing is available upon request and may be subject to separate written agreements.

13. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida.

14. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time without prior notice. Changes become effective immediately upon posting to our website. Your continued use of our website or services after any changes are posted constitutes your acceptance of the revised terms. We encourage you to review these Terms periodically.
